Terms and Conditions

These terms and conditions do not affect the customer’s statutory rights.

Orders

Orders from UK only are accepted. This is due to the fresh nature of the product and we can not guarantee its quality due to the long transit it will take for orders outside the UK.

All payments must be paid in full before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.

You are not permitted to sell and must not offer for sale or re-sell any of our products.

All orders are subject to VAT (already included in the prices)

Orders are delivered via the Royal Mail and are sent first class signed for.

Workshop

Our workshop which creates of all our chocolates is a domestic kitchen. Therefore please note that nuts, dairy products, gluten, meat and fish products are cooked in the workshop. The workshop is thoroughly cleaned prior to any chocolates being made in accordance to legislation issued by the Government as a guide to the safe handling of products.

Some of our chocolates contain nuts and gluten products. In this case, these products are made last to avoid any cross contamination.

Chocolates

Due to the unique handmade nature of our chocolates, we can not guarantee they will look exactly the same as in the photographs on the website.

Returns

In the unlikely event of the goods being found to be faulty please report it to The Chocolate Mill MK within 2 days of delivery, a refund or a replacement will be arranged with the customer.

Delivery damage

We at The Chocolate Mill MK do our level best to ensure products leave our workshop at the highest possible standards and while we do our best to ensure products arrive as safely as possible, we can not be held responsible for damage done to the product in transit.

In the event of damaged or faulty goods, customers must contact The Chocolate Mill MK in writing by emailing info@thechocolatemillmk.co.uk within 5 days of dispatch email being sent.

The Chocolate Mill MK will only send a replacement product, upon confirmation that the damaged items have been returned. Goods must have been kept according to storage instructions from the day of delivery.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the products in question under clause above.

Price

The prices payable for products that you order are as set out in our website. These prices may vary.

Deliveries

Prices are excluding, delivery charges, which are set out during the order process and on the relevant content page. For delivery prices, details and lead times please contact us on info@thechocolatemillmk.co.uk

We will deliver the products to the address you give us whilst ordering. It is your responsibility to provide us with accurate delivery address details. We will not check or verify addresses and messages supplied by you.

You will become the owner of the products you have ordered when they have been delivered to you. Once products have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

Liabilities

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase products from our site. The importation or exportation of certain products to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the products you purchase.

The Chocolate Mill MK excludes all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party in connection with this website in any way or in connection with the use, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing this website or your downloading of any material from this website or any websites linked to this website.

The Chocolate Mill MK tries to ensure that the information on this website is accurate and complete but will not be liable for any damages of any kind arising from the use of this website.

This online shop is covered by public liability insurance.

Temperature

We cannot be held responsible for heat damage to products and/or packaging in transit. Due to the high temperatures during the summer months, we kindly ask all customers to provide an address where your chocolates can be safely delivered by the courier on their first delivery attempt (e.g. work address). We take all necessary precautions with regards to high temperatures in order to provide our customers with the best possible service.

We cannot take responsibility for melted or stolen chocolates in situations where customers authorise couriers to leave parcels on a doorstep.

Intellectual property

The content of this website is protected by copyright, trademarks, database right and other intellectual property rights. You may not reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on this website without written permission from The Chocolate Mill MK.

Refusal

We may suspend or cancel your registration immediately and reserve the right to refuse sale of goods at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.

Cancellation

Orders may be cancelled at any time prior to dispatch by email or phone.

Unforeseen circumstances

While every effort will be made to meet customer’s demands, cancellations or variations may be necessary as a result of Act of God, War, Strike, Lockout, Labour Dispute, Fire, Flood, Drought or other causes beyond the control of The Chocolate Mill MK.

Conclusion

These terms are governed by English law. Any contract for the purchase of goods from this site and any dispute or claim arising out of or in connection with any such contract will be governed by English law. You and we both agree that the courts of England and Wales will have non-exclusive jurisdiction.
